Terms and Conditions

The mindforsoul.ro website is operated by Mind for Soul SRL, with its registered office in Bucharest, str. Dr. Iacob Felix no. 21, room 4, registered with the Trade Register under no. J2017001500033, tax ID (CUI) 37807558, e-mail: contact@mindforsoul.ro, phone: 0747 277 727.

Using the website and sending a request through the contact form mean that you have read and accepted these Terms and Conditions. The services are intended for people aged 18 or over. If you do not agree with these terms, please do not use the website.

Mind for Soul SRL provides patient guidance and management services, consisting of: reviewing the situation described by the user, guidance towards specialist doctors, investigations, clinics and other appropriate medical resources, and support in scheduling consultations and organising the medical journey. Mind for Soul SRL is not a healthcare provider: it does not diagnose, prescribe treatment or give a medical interpretation of test results, and it does not replace a specialist medical consultation.

The information and guidance provided by Mind for Soul SRL are for orientation only and do not constitute medical advice or medical acts. The contact form, e-mail address and phone number are not monitored at all times and must not be used in emergencies. We reply to requests on working days, Monday to Friday, between 09:00 and 18:00, usually within 24 hours. In a medical emergency, call 112 immediately or go to the nearest emergency department.

Mind for Soul SRL is not part of the medical units it recommends. Mind for Soul SRL may have contractual relationships with certain healthcare providers; this does not influence its recommendations, which are made in the patient's interest, and on request we will tell you whether a recommended provider is in such a relationship. The choice of provider rests solely with the user.

The user undertakes:

• to provide true, correct and complete information;
• to send data and medical documents concerning another adult (for example, a family member) only with that person's consent or as their legal representative. Mind for Soul SRL's services are intended exclusively for adult patients;
• to attach only the documents strictly necessary to assess the situation;
• not to use the website for unlawful purposes and not to send false, offensive or harmful content through it.

7.1. The initial assessment discussion is free of charge and does not oblige the user to purchase any service.

7.2. The fee for the patient management service is 500 RON, VAT included, per case. A “case” means a single medical problem of a single patient, for which Mind for Soul SRL provides a review of the situation, guidance towards the appropriate specialists, investigations and medical units, and support in organising the medical journey, until the end of treatment but for no longer than 12 months from the date of payment. A new case arises in the event of: (a) a new medical problem; (b) a different patient; (c) the complete replacement of the medical team with a new team; (d) continued assistance after the 12-month period has expired.

7.3. The contract is concluded at a distance, on the date on which the user confirms in writing, including by e-mail, that they wish to purchase the service, after receiving from Mind for Soul SRL confirmation of the service, the fee and these Terms and Conditions.

7.4. Payment is made before the service begins, by one of the following methods: bank transfer, cash or an online payment link. Payments by link are processed by an authorised payment service provider, and Mind for Soul SRL has no access to card details.

7.5. Mind for Soul SRL issues a tax invoice for each payment. The invoice is sent to the user by e-mail or WhatsApp and uploaded to the national RO e-Factura system (SPV), in accordance with the tax legislation in force.

7.6. Doctors' fees, the cost of investigations and any other services of healthcare providers are not included in the fee and are paid directly to them.

8.1. The user has the right to withdraw from the contract within 14 calendar days of its conclusion, without giving any reason, by sending a notice to contact@mindforsoul.ro.

8.2. If the user expressly requests that the service begin before the withdrawal period expires and subsequently withdraws, they owe an amount proportionate to the services provided up to the date the withdrawal was communicated.

8.3. The right of withdrawal no longer applies once the service has been fully performed, i.e. once the case has closed within the meaning of section 7.2, if performance began with the user's prior express consent and the user acknowledged that they would lose the right of withdrawal.

8.4. Amounts owed to the user are refunded within 14 days of the date the withdrawal was communicated, using the same payment method as the original transaction, unless the parties agree otherwise.

9.1. Mind for Soul SRL does not guarantee any particular medical outcome.

9.2. Mind for Soul SRL is not liable for:

• the acts, diagnoses, treatments or conduct of the recommended healthcare providers;
• decisions taken by the user on the basis of the guidance received;
• the consequences of the user providing incomplete or incorrect information;
• delays, cancellations or unavailability of healthcare providers.

9.3. To the extent permitted by law, the total liability of Mind for Soul SRL towards the user may not exceed the fee paid for the service, namely 500 RON.

The information sent, including health data and medical documents, is accessed only by Mind for Soul SRL staff involved in providing the service, who are under contractual confidentiality obligations. In order to provide the service, this information will be shared with the doctors and medical units the patient is guided to. Details of the processing of personal data, including the conditions under which it is shared, are set out in the Personal data processing policy, published on the website, and in the personal data processing agreement.

We may communicate with users by e-mail, phone or WhatsApp. WhatsApp is a third-party service and is subject to its own privacy terms. For this reason, we recommend that you do not send medical documents via WhatsApp and that you use the form on the website or the e-mail address contact@mindforsoul.ro instead.

The content of the website (texts, logo, graphic elements, articles) belongs to Mind for Soul SRL and may not be reproduced, distributed or used without its written consent. Articles published on the blog are for general information only and do not replace a specialist medical consultation.

The website may contain links to websites operated by third parties. Mind for Soul SRL is not responsible for the content, availability or privacy policies of those websites.

Mind for Soul SRL may amend these Terms and Conditions. The updated version is published on the website and states the date of the latest update. Changes do not affect contracts concluded before their publication.

These Terms and Conditions are governed by Romanian law. Any disagreement shall first be settled amicably. Failing that, the dispute will be settled by the competent courts in Romania. Consumers may contact the National Authority for Consumer Protection (www.anpc.ro) and may use the alternative dispute resolution (ADR/SAL) procedure.
